What Does the ™ Symbol Mean and When Should You Use It?

Writer: trademarks0trademarks0

If you’ve ever noticed the  symbol next to a business name, product, or catchy phrase, you might be wondering what it actually means and how it differs from the ® symbol. Whether you’re a coach, creative, or entrepreneur, understanding trademarks is essential to protecting your brand.

In this post, we’ll break down the meaning of the  symbol, when you should use it, and why trademark protection matters.

What Does the ™ Symbol Mean?

The  symbol stands for trademark and is used to indicate that a business or individual is claiming a word, logo, phrase, or other brand element as their exclusive identifier. Unlike the ® symbol, which signifies a registered trademark, the ™ symbol does not require official registration with a trademark office.

Essentially, when you use ™, you’re putting the world on notice that you consider a particular name, slogan, or logo to be your trademark. It signals that you are asserting ownership and branding rights—even if you haven’t formally registered the trademark.

How Is the ™ Symbol Different from the ® Symbol?

Many business owners confuse  and ®, but they have very different legal implications:

🚨 Important: You cannot use the ® symbol unless your trademark is officially registered with the Canadian Intellectual Property Office (CIPO) or the United States Patent and Trademark Office (USPTO). Misuse of the ® symbol could lead to legal consequences!

When Should You Use the ™ Symbol?

You should use the  symbol whenever you want to indicate that a particular word, phrase, or logo is associated with your brand even if you haven’t filed a trademark application yet. This is especially useful when:

• You’re in the early stages of branding and haven’t registered your trademark yet

• You want to deter others from using your name, logo, or slogan

• You’re in an industry where branding is critical, and you want to signal that you consider something your intellectual property

While the ™ symbol doesn’t provide official legal protection, it can still help establish your brand identity and support your case if you ever need to enforce your rights.

The  symbol is a powerful way to signal that you’re claiming ownership of a brand element, but it doesn’t provide the same legal protection as a registered trademark. If you’re ready to take the next step in protecting your business, consider getting a comprehensive availability search and filing for official trademark registration to secure your brand’s future.
